Terms of Service

    By installing PitchFlow or using pitchflow.work, you agree to these terms. If you do not agree, please uninstall the extension and do not use the service.
  

1. The service

PitchFlow ("the Service") is a Chrome browser extension and API that helps freelancers on Upwork generate draft proposals using artificial intelligence. The Service is operated by Ludovic Bribaud ("we", "us", "PitchFlow").

The Service is provided as a productivity tool. Proposals it generates are drafts — you are responsible for reviewing, editing, and deciding whether to send them.

2. Eligibility

You must be at least 16 years old to use the Service.
You must have a valid Upwork account and comply with Upwork's own Terms of Service.
You must not use the Service in any jurisdiction where doing so is prohibited by law.

3. Account and authentication

You may use the Service by signing in with your Google account. You are responsible for keeping your credentials secure. You must not share your account with others or use the Service to generate proposals on behalf of third parties without their explicit consent.

We reserve the right to suspend or terminate accounts that violate these Terms or that are used for fraudulent or abusive purposes.

4. Free plan and subscriptions

The Service offers a free plan and a paid Pro plan.

4.1 Free plan

The free plan includes a limited number of AI-generated proposals per calendar month (currently 5). Limits are subject to change with reasonable notice.

4.2 Pro plan

Pro subscriptions are billed monthly or annually via Stripe.
You may cancel at any time. Cancellation takes effect at the end of the current billing period — you retain Pro access until then.
Refunds are issued at our discretion within 7 days of purchase if the Service did not function as advertised. Contact hello@pitchflow.work.
We reserve the right to change pricing with at least 30 days' notice. Existing subscriptions continue at the current price for the remainder of the billing period.

5. Acceptable use

You agree not to:

Use the Service to generate deceptive, misleading, or fraudulent content.
Attempt to reverse-engineer, scrape, or extract the underlying AI prompts or models.
Automate requests to the Service at a rate that exceeds normal human use.
Resell or sublicense access to the Service.
Use the Service in a way that violates Upwork's Terms of Service or any applicable laws.
Attempt to bypass quota limits through multiple accounts or other means.

Violation of this section may result in immediate termination of your account without refund.

6. AI-generated content

Proposals generated by PitchFlow are produced by a large language model (currently OpenAI's API). You acknowledge that:

AI-generated content may contain inaccuracies, errors, or statements that do not reflect reality.
You are solely responsible for reviewing all generated content before sending it to any client.
We do not guarantee that generated proposals will result in awarded contracts.
You own any proposal text generated for your profile — we claim no intellectual property rights over outputs.

7. Intellectual property

The PitchFlow extension code, branding, website, and proprietary prompts are owned by PitchFlow and protected by copyright. You may not copy, modify, or redistribute them without written permission.

Your profile data and any content you enter remain yours. By submitting profile content to the Service, you grant us a limited, non-exclusive licence to process it solely for the purpose of generating proposals on your behalf.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT PROPOSALS GENERATED WILL BE ACCURATE OR EFFECTIVE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PITCHFLOW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM, OR €10, WHICHEVER IS GREATER.

10. Upwork relationship

PitchFlow is an independent third-party tool and is not affiliated with, endorsed by, or sponsored by Upwork. "Upwork" is a trademark of Upwork Inc. Use of PitchFlow does not imply any relationship with Upwork Inc.

11. Changes to the service and terms

We may modify the Service or these Terms at any time. Material changes will be communicated via email or an in-extension notice with at least 14 days' notice. Continued use of the Service after the effective date of changes constitutes acceptance of the new Terms.

12. Termination

You may stop using the Service and uninstall the extension at any time. We may suspend or terminate your access for violation of these Terms, with or without notice depending on the severity of the violation.

Upon termination, your right to use the Service ceases immediately. Sections 6, 7, 8, 9, and 13 survive termination.

13. Governing law and disputes

These Terms are governed by the laws of France, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts of Paris, France, unless mandatory consumer protection law in your country provides otherwise.
